Abstract: This works-in-progress presentation considers the apparent tension between abortion rights and the recognition of pregnancy loss. Scholars and activists who support abortion rights are often afraid to acknowledge the loss after miscarriage, stillbirth, and even abortion because they fear the slippery slope to legal personhood. In this paper, the authors argue that this fear is misguided and that the abortion rights community has more to gain than lose by supporting pregnancy loss. This work-in-progress presentation will consider the relationship between abortion law and pregnancy loss in the law.
